US: Terms and conditions of use

Hello, how are you? It is with great pleasure that we welcome you to our platform. We are a Brazilian company, responsible for one of the most complete applications for remote/virtual condominium call centers.

We are a Brazilian company, holder of the rights to design, develop, market and be directly responsible for the largest and most complete solution for remote/virtual, face-to-face, and autonomous condominium entrance gatehouse call centers.

We emphasize the importance of also reading and understanding our Privacy and Data Protection Policy, as relevant information is described therein for the complementation of this document.

The application services are provided by TECNORISE DESENVOLVIMENTO DE SOFTWARE LTDA., referred to in this document as Tecnorise, a legal entity registered under the Brazilian Company Registration No. 29.179.880/0001-97, located at Avenida Santos Dumont, No. 2456, Suite 1301, Aldeota, Zip Code 60150-161, Corporate Plaza Business Center building, in Fortaleza, Ceará, Brazil. We are the owner of the intellectual property rights over the software, website, applications, content, and other assets related to this application.

Who is the data controller?

About the purpose

The platform aims to license the use of its software, website, applications, and other intellectual property assets, providing tools to assist and streamline the daily lives of its users.

The platform is characterized by providing the following services:

  • Complete registration form for residents, employees, and visitors;
  • Access device registration;
  • Vehicle registration;
  • Notification for registration directly in the central;
  • Criation of new application activation tokens;
  • Choice of call for your unit;
  • Notification of received mail;
  • Reservation of spaces;
  • Message board by the condo manager;
  • List of documents;
  • Incidents;
  • Direct messages from the central;
  • Push notifications;
  • Virtual invitations with individual sending and access via mobile key or Smart QR Code;
  • Access to cameras;
  • Access authorization through the application;
  • Arrival notification;
  • Panic alert;
  • Mobile Key;
  • Customer Service: direct channel with the integration company;
  • Unit access reports;
  • Access to multiple units and/or condos;
  • In specific cases for condos with autonomous service, VOIP service (G-Phone) directly from the application.
About acceptance

These Terms establish obligations contracted of free and spontaneous will, for an indefinite period, between the platform and natural or legal entities, users of the application. By using the platform, the user fully accepts these rules and agrees to observe them, under the risk of applicable penalties. Acceptance of these terms is essential for access and use of any services provided by the company. If you do not agree with the provisions of this document, the user should not use them.

Regarding User Access:

All technical solutions available to Tecnorise will be used to allow access to the service 24 (twenty-four) hours a day, 7 (seven) days a week. However, navigation on the platform or any of its pages may be interrupted, limited or suspended for updates, modifications, or any action necessary for its proper functioning.

Regarding Registration:

Access to the platform's functionalities will require prior registration. When registering, the user must provide complete, recent, and valid personal data for which they are solely responsible. The user may change their registration data in the application at any time, being solely responsible for the accuracy, updating, and correctness of said data.

The user agrees not to provide their registration and/or access data to third parties, and is fully responsible for the use made of them. The use of the platform, services, and/or products by minors under 18 years old and/or those who do not have full civil capacity will be conditioned upon the specific consent granted by at least one of their parents or legal representatives, and their personal data will always be treated in their best interest. The use of the application by minors under 18 years old and/or those who do not have full civil capacity without the respective specific consent mentioned above is strictly prohibited.

By registering, the user declares and expressly warrants that they are fully capable, being able to freely use and enjoy the services and products. After registering on the platform, the user receives an activation token for the application. This alphanumeric token, consisting of 6 (six) characters, is generated in such a way that, after being enabled, it loses its power of new activation, thus being individually accessed by each user with the privilege of using the app.

With the activation token in their possession, it is the user's exclusive responsibility to maintain said password confidential and secure, avoiding unauthorized access to personal information. Through this application, it is possible at any time to generate a new activation token for an existing user or a newly registered one.

Therefore, all activity carried out using the activation token will be the responsibility of the user who generated and/or holds it, and they undertake to promptly notify the integrating company of its invalidity in case of misuse of the respective code. It will not be allowed to transfer, sell, rent, or transfer the activation token in any way, as it is personal and non-transferable. It should be noted that, upon generating a token for a particular user, it expires for new activations, and in case a new token needs to be created, the previous one is invalidated, causing access to the user's application to be disabled.

It is the user's responsibility to ensure that their equipment is compatible with the technical characteristics that enable the use of the platform and its services or products. The user may cancel their registration with the platform at any time. By accepting these Terms of Use, the user is aware that the platform will process their personal data for the necessary or legally determined time, for the specific purpose of enabling the use of the application and the legal relationship between the parties, and may also share their personal data with third parties when necessary to execute services, guaranteeing, however, the confidentiality, integrity, and availability of said personal data.

Responsibilities

It is the user's responsibility to:

  • A) correct technical defects or malfunctions originating in the user's own system;
  • B) correctly use the platform, services, or products offered, valuing good coexistence, respect, and cordiality among users;
  • C) comply with and respect the set of rules set forth in these General Terms and Conditions of Use, the respective Privacy Policy, and national and international legislation;
  • D) protect personal data to access their account/profile.

It is the platform's responsibility to:

  • A) help to indicate the service's characteristics;
  • B) defects and malfunctions found in the service or product offered, as long as the defect or malfunction was caused by Tecnorise;
  • C) the confidentiality of the relevant information that has been disclosed to Tecnorise;
  • D) eventual illegal content or activities carried out through its platform;
  • E) adopt technical and administrative measures necessary to ensure the protection of personal data processed due to registration and use of this application.
Functionality: Health Emergency

Tecnorise is not responsible for the receipt of emergency calls or their processing. The User must have active internet, Wi-Fi, and electrical energy services available for the use of the Health Emergency functionality.

Therefore, Tecnorise is exempt from any responsibility for the provision of incidental or associated services related to emergency calls made through the Health Emergency functionality, including but not limited to an act or omission involving:

  • A) development, design, installation, operation, maintenance, performance of devices, equipments or facilities that allow the User to use the Health Emergency functionality;
  • B) errors, interruptions, delays, misunderstandings, network interruptions, failures, defects, technical difficulties, nature events, or other occurrences independent of their cause, which may arise during the transmission and execution of emergency calls or emergency services provision; and
  • C) emergency service execution, which may be though a medical service provider, public emergency service, fire department service, or any other form of emergency service execution. Tecnorise is not responsible for the unfeasibility of activating emergency services due to their unavailability in the region and/or their refusal to respond to the emergency call request.
Copyrights

This Terms of Use grants users a non-exclusive, non-transferable, and non-sublicensable license to access and use the platform and the services and products made available by it.

The structure of the website or application, trademarks, logos, trade names, layouts, graphics and interface design, images, illustrations, photographs, presentations, videos, written and audio content, computer programs, databases, transmission files, and any other intellectual property rights of Tecnorise, subject to the terms of the Industrial Property Law (Law no. 9,279/96), Copyright Law (Law no. 9,610/98), and Software Law (Law no. 9,609/98), are duly reserved.

This Terms of Use does not assign or transfer any rights to the user, so access does not generate any intellectual property rights for the user, except for the limited license granted herein.

The user's platform access is personal, individual, and non- transferable, and any unauthorized, commercial or non-commercial access is prohibited. Such accesses will constitute a violation of Tecnorise's intellectual property rights, punishable under applicable legal framework.

From Support

Without prejudice to any other legal measures available, Tecnorise may, at any time, warn, suspend or cancel the user's account who:

  • A) violates any provision of these Terms;
  • B) fails to comply with their user duties;
  • C) engages in any fraudulent, intentional or offensive behavior towards third parties.
Termination

Failure to comply with the obligations agreed upon in these Terms of Use or applicable laws may, without prior notice, result in immediate unilateral termination by Tecnorise and the blocking of all services provided to the user.

Changes

The items described in this document may be unilaterally and at any time modified by Tecnorise to adapt or modify services, as well as to comply with new legal requirements. Changes will be updated on the website and application, and the user, to continue use, accepts the new content or, if they disagree, must cancel their registration on the application. The request to cancel the registration, if allowed by the security company hired by your condominium, with the consequent permanent exclusion of personal data, except for the maintenance hypotheses provided by law, can also be made directly on the application by accessing the "MY UNIT" option on the main menu, followed by "CONDOMINIUMS". In the list of condominiums, select the registration to be deleted and at the end of the chosen registration form, click the "DELETE" button and confirm the action.

Access to the Privacy Policy

Any and all processing of personal data will strictly comply with Tecnorise's Privacy Policy, which can be consulted at the link https://tecnorise.com/politica-de-privacidade. These Terms of Use are fully linked to the aforementioned Privacy Policy.

Venue

This Terms of Use are linked to the Privacy Policy, available on the application’s main portal, and will be interpreted according to Brazilian legal framework, with the Central Forum of the Court of Fortaleza/CE being elected to settle any dispute, question, or subsequent doubt, with express waiver of any other, no matter how privileged it may be. Furthermore, the processing and collecting of personal data by TECNORISE is in harmony with the directly applicable data protection laws of Florida, notably the Florida Information Protection Act (“FIPA”).

This document has been prepared in Portuguese and English, but in case of any discrepancy between the versions, the Portuguese version shall prevail.

Updates

These terms come into effect from the date of their publication. Updates may be made by Tecnorise, and thus, the published version is considered valid. However, we recommend that the Privacy Policy and Terms of Use be consulted regularly. This document was updated in September/2022.
